Boat Dockage

Therefore, for the consideration as hereafter expressed, Marina agrees to rent to Owner a boat slip for the Boating Season stated above, which is described as a period of time between April 15 and October 31st.

The Owner represents that he/she is the registered owner of the vessel described above and that the address given is his/her current address. Owner agrees to provide Marina with a copy of the registration to the vessel and agrees to promptly inform the Marina of any change in the personal information that the Owner has provided.

The Owner shall make the agreed-upon deposit for boat slip rental.Boat slips must be paid in full within 24 hours of first launch. Deposits paid hereunder are non-refundable. If necessary, fees may be refunded on a prorated basis. The Owner's vessel shall not be provided dockage unless and until Owner pays Marina any and all fees and/or charges required.

If Owner becomes one (1) month delinquent in payment of any fees, Marina shall have the right to repossess the dock space assigned to Owner's vessel and to secure the vessel in a separate location. The Marina shall charge the Owner for the expenses incurred to transport the vessel. The Marina and Owner agree that any dock space made vacant due to the removal of Owner's vessel may be rented to another party by the Marina at the discretion of the Marina. There will be no refund to the Owner where in the Marina repossesses dock space.

This agreement may be renewed at the Marina's option, subject to change of terms and conditions. Marina will transmit renewal Contract to Owner at least 30 days prior to beginning of Boating Season. Failure to return executed copy of the Contract by April 1", may, at the option of the Marina, be denied the right of renewal.

The Owner understands and agrees that the Owner's vessel shall not be launched at or removed from the Marina's property if Owner is delinquent in any payment or service charges due to the Marina, which shall subject Owner's vessel to a vessel lien.

The Owner agrees to keep vessel in a seaworthy condition and shall create neither a fire hazard, eyesore, nor a sinking hazard. Owner agrees to keep vessel properly moored and dry within, at all times.

The Marina may be required to move Owner's vessel and therefore shall, from time to time, assign Owner a slip number for the purpose of identifying location of vessel. It is understood that vessel location and slip number can change to facilitate placement, Marina operations, or to maximize safety procedures at the Marina. Marina will notify Owner if such instances occur.

The Owner hereby expressly assumes full responsibility for any and all loss or damage to Owner's vessel or Owner's other property. Owner also assumes full responsibility for any and all loss or damage caused by Owner's vessel or Owner's other property.

The Owner agrees that it is his/her sole responsibility to make, or have made, periodic inspections of said vessel while it is in dockage to ensure that the vessel and covering is secure.

The Marina assumes no liability against any loss, liability, or damage for injuries to person or property, and Owner agrees to carry his/her own insurance to protect his boat, property and person against any loss and save Marina harmless. Owner must provide Marina with a Certificate of Insurance indemnifying and saving Marina harmless. Marina assumes no responsibility for minor surface scratches that may occur through normal handling of Owner's boat.

The Owner understands that the rights and privileges granted in the Agreement are personal and not assignable by Owner for any reason. Any attempt by Owner to assign his/her rights or privileges unto this Agreement may result in immediate termination of the Agreement. In such event, Owner shall receive no refund of money paid through the date of the attempted assignment.

The Owner understands that only those vendors who have provided adequate proof of insurance may do work on Owner's vessel on the Marina's property.

The Owner hereby agrees, and shall abide by Marina's Rules and Regulations, which are attached hereto and incorporated herein by reference. Said Rules and Regulations may be periodically amended by marina in its sole discretion.

The Owner agrees that marina may terminate this Agreement immediately upon written notice, without refund to Owner at Owner's last known address if Owner violates or permits the violation of or fails to perform any of Owner's covenants, duties, or obligations (as periodically amended in the Rules and Regulations).
