Rules and Regulations
CARPET - No carpet allowed on dock stakes, only rubber. Carpet may be placed on the dock surface, but only with the approval of marina and the adjacent dock renter.
CLOTHESLINE - No permanent clotheslines are allowed.
CONTRACT - Contracts are non-transferable and cannot be sublet. Contracts are in effect from April Is through October 31st of the contract year. Early and/or late occupancy may result in additional charges/fees/rent above and beyond the contracted price. All boats must be out of the water by November 1st. Any change in ownership of the vessel or change of the vessel itself, must be reported to the marina and may require a new contract.
DAMAGE - Happy Days Marina reserves the right to bill the dock renter for any damage to marina property or the clean-up of marina property that are the result of the a dock renters action. Billable items are, but not limited to the following: broken dock stakes, damage to electrical boxes, broken water fixtures, fuel and/or oil spills, damage to shower/restroom facilities, etc.
DOCK LOCATION - Dock assignments are made by and subject to change at the discretion of marina and are to be in the best interest of everyone.
ELECTRIC - Unless otherwise disclosed, the contract price includes electric for your boat only. No dock renter may make any changes to the electric at their dock without written approval by the marina. Any work done must be by a licensed electrician, be done to code, and at the docker's expense. There is a $50.00 fee for any additional shore power and a $100.00 fee for approved dockside refrigerators and/or freezers.
FIRES - No fires, including charcoal boilers, are permitted on boats or docks located in the marina area.
FUELING - No fueling of vessels dockside will be permitted without complete and total permission of marina management, as well as verification of all insurance and safeguards. If permission is granted, it will be on a case by case basis, with at least one (1) member of the Happy Days staff present, and will be at the cost of the party requesting the fueling. Violation will be cause for immediate eviction.
GUESTS - Boat owners will be responsible for the conduct of their family and guests. Hold harmless - Happy Days Marina does not carry insurance covering the property of the dock renter. Happy Days will not be responsible for any injuries to persons or property damage resulting or caused by the use of the dock or marina facilities. The dock renter releases and discharges Happy Days Marina from any and all liability from loss, injury (including death), or damage to persons or property sustained while in or at the marina, including fire, theft, vandalism, and acts of God.
INSURANCE - Owners are required to full insure their boat against damage and theft, and for liability. Proof of insurance is mandatory upon entering the contract.
Lack of or cancellation of boater's insurance will result in the termination of the contract.
MARITIME LIEN - Happy Days Marina shall place a lien against the boat for any loss, damage, or expense to the marina or its property occasioned by: use or misuse of the boat, dockage, storage, and other charges accrued and thereafter accruing, plus interest and attorney's fees. If said fees remain unpaid past November 1st of the contract year, such lien shall extend to the boat wherever located and Happy Days Marina shall be entifled to possession of the boat to enforce its lien and other rights.
OTHER VESSELS - Dockage covers the mooring of one (1) watercraft only. Small watercraft shall not be moored for prolonged periods, alongside the primary vessel, at the dock, or off the forward bulkhead of the primary vessel. All secondary watercraft must be registered with the marina. All secondary watercraft, without their own dockage arrangements, must be removed from the water when not in use. Secondary watercraft that will be in the water for a prolonged period of time, must have a signed dockage contract on file with the marina prior to occupying dock space. Storage of any watercraft in the marina area, without prior approval, is not allowed. Short term and long term storage is available upon request and for a fee depending on size of the watercraft.
PARKING - Only one (1) vehicle should be parked in front of your dock space. Be courteous of your dock partner. Any additional vehicles should be parked in the adjacent grassy area. RV's, boat trailers, PWC's, etc. are prohibited. Trailer storage is available for $200.00.
PETS - Pets of any kind shall and will be kept on leashes or in appropriate kennels/cages and are the responsibility of the pet owner and docker. ALL waste must be cleaned up immediately. Failure to do so could result in loss of privileges.
Management reserves the right to request the removal of any dog that is perceived as a nuisance or a danger. Pets may not be left unattended.
REFUNDS - Deposits are non-refundable.
RESPONSIBILITIES - The boat owner must maintain their dockage space and adjacent area in a neat and clean manner. Utilities (water & electric) shall be obtained by proper connection at the shore. Direct connection to any service is not permitted. Dock boxes shall be kept in good condition and are subject to marina review at the discretion of the marina. No refrigerators or freezers (or the like) are permitted on the shore without management approval and the payment of the appropriate fee.
RESTROOM/SHOWER FACILITY - Use of the facilities are for registered dockers and their guests only. These facilities are to be treated with respect. Damage to the facilities will result in the dock renter being charged for the repairs. Excess damage to any part of the building will result in termination of the dockage contract.
WASTE DISPOSAL - All trash and waste (excluding oil, filters, sewage, etc.) are to be placed in the dumpster provided. No waste is to be thrown into the water.
There will be no fish cleaning at the marina. Nor shall there be any fish cleaning remains disposed of on the marina property. Oil and other related items, including batteries, are to be disposed of in the special area. Please contact the marina for the disposal of these items. Federal law can assess a fine of not less than $500.00 if improper disposal occurs.
WATER USAGE - City water is provided for the convenience of the customer at all taps in the marina. However, the marina reserves the right to restrict use of water if and when abuse occurs. The marina also reserves the right to charge $25.00 for excessive water usage.
WORK ON BOAT - Boat owners may work on their watercraft within the marina so long as such work does not interfere with other boaters or the operation of the marina. The main office shall be notified no less than 48 hours in advance prior to the start of any work done by an outside source. Proof of proper insurance and an understanding of environmental safeguards and practices will be required.
VIOLATION OF RULES AND REGULATIONS - Any violation of any of the above Rules and Regulations may result in the termination of dockage contract at marina's discretion.
