DISCLOSURE
Boats must be brought in for storage by 11/1, a 50% late charge will be applied to all work done after that date. Your boat must be pumped out before coming in as we do not have pump out facilities. There will be a surcharge of $100.00 for any boats that need to be pumped out. Happy Days Boating Company not responsible for any boat leaving premises after winterization.
If your boat is brought in after the first freeze, Happy Days Boating Company will not be responsible for any damages incurred.
Our contract with you is ONLY for the storage of your boat and its contents, if stored, is as stated below, and is expressly limited to the following: we will store your boat for the winter storage period. We act as lessors of space, and you are the lessee of space, for storage. We will NOT be liable for damage to your boat and any other equipment by fire, windstorm, vandalism, or any other cause whatsoever. Our sole and exclusive agreement with you is to keep your boat in storage during the customary storage period in the Port Clinton area. You are responsible for procuring insurance on your boat and allied equipment against all perils of any kind while your boat is stored with Happy Days Boating Company. The lessee hereby expressly releases and discharges the lessor, its servants, and employees from any claim or cause of action for any loss or damage whatsoever arising out of any negligence or alleged negligence of the lessor, its servants, and employees, resulting from fire, smoke, or explosion in the building or premises, it being the intention of the parties that the lessee shall look only to his own insurance carrier for payment of any loss. By signing this agreement of storage, you also agree that, in the event of a loss, you will not, as a condition of payment of your loss by your insurer, sign any type of subrogation agreement or receipt whereunder or whereby you sell, assign, or set-over any portion of your loss or damage claim to your insurer for eventual claim against Happy Days Boating Company. NOTE: In order to preserve your fire insurance coverage, you should obtain from your fire insurance carrier, an endorsement on your fire insurance policy or policies waiving any rights of subrogation against the lessor, its servants, agents, or employees.
CERTIFICATE
I certify that I am the owner of the boat and other equipment listed above, that I have read and understand the terms and conditions set forth above, and that I agree to each one of them without exception. I further certify that I have obtained insurance coverage for my boat and accessories, while in storage, with the below named insurance agent. If I choose not to provide insurance coverage for my boat, by signing below I acknowledge that I have chosen to be personally liable for all damage to my boat. I release Happy Days Boating Company from any and all liability for damage to my boat from fire, windstorm, vandalism, or any other cause whatsoever.
